[CONFIRM WITH VAY] This is a tailored draft, not legal advice. Please read it through, fill in every bracketed item, and ideally have it checked by someone qualified before go-live. The items needing your input are listed at the bottom. Last updated: to be set on publish.
These terms apply to your use of the Custom Canine Training website and to anything you buy from us: online courses, an Access all courses and lessons membership, or in-person training and events. Please read them before you buy. By creating an account, buying a course or membership, or booking a session, you agree to them.
1. Who we are
Custom Canine Training (“we”, “us”, “our”) is a dog training business based in Stafford, England, run by Vay [surname]. Trading status: [sole trader or limited company, to confirm; if a limited company, add the company name, number and registered office]. You can reach us at vay@customcanine.co.uk or by phone on 07810 836906. Our correspondence address is [address].
2. Definitions
- Course means a set of training videos and materials sold as a one-off purchase.
- Access all courses and lessons means our membership giving access to every course (and new courses we add) for a recurring monthly or annual fee.
- Digital content means the videos, downloads and written materials we provide online.
- In-person training means 1-2-1 sessions, classes, workshops and events delivered in person.
- Account means the login you create to access purchased content.
3. Your account
You need an account to buy and watch our online content. You must give accurate details, keep your password secure, and not share your login. Your access is for you (and your household) only. You are responsible for activity under your account. Tell us straight away if you think someone else has used it.
4. Our services
We provide online dog-training courses, an Access all courses and lessons membership, and in-person training and events. Course descriptions, what is included, and the level they suit are shown on each course page. We describe our services honestly, but we cannot promise a specific result for your dog (see section 12).
5. Prices and payment
Prices are shown on the site in pounds sterling and include any applicable tax. Online payments are handled by our payment provider, Stripe. We do not see or store your full card details. By paying you confirm you are authorised to use the payment method. If a payment fails or is reversed, we may suspend access until it is resolved. We may change prices from time to time, but a change will not affect a one-off course you have already bought, and we will tell existing members before a membership price change takes effect.
6. Online courses: access and licence
When you buy a course, you get access to its digital content through your account. A one-off course stays available to you for as long as we run the site and offer that course (we will give reasonable notice if we ever retire a course). We grant you a personal, non-transferable, non-exclusive licence to watch and use the content for training your own dogs. You must not download (except where we expressly allow it), copy, record, screen-capture, share, resell, broadcast or republish the videos or materials, or give anyone else access to your account. The content and all intellectual property in it remain ours.
7. Access all courses and lessons membership
This is a recurring subscription, billed monthly or annually depending on the plan you choose. It gives you access to all current courses and any new courses we add while your membership is active.
- Renewal: it renews automatically each period using your saved payment method until you cancel.
- Cancelling: you can cancel at any time from your account, or by emailing us. Cancellation stops the next renewal. Your access continues until the end of the period you have already paid for. We do not give part-period refunds for time left after you cancel, except where the law requires it (see 8 and 9).
- If you stop paying: if a renewal payment fails, we may retry it and may suspend or end your access.
- A membership is not the same as owning a course. If your membership ends, your access to the courses ends too, unless you also bought a course outright.
8. Your right to change your mind (14-day cancellation)
Because you buy from us online, you normally have 14 days from purchase to cancel for a refund under the Consumer Contracts Regulations 2013. There is an important exception for digital content:
- Online courses and membership (digital content): when you buy, you ask us for immediate access and you agree that, by starting to watch or download the content within the 14-day period, you lose your right to cancel for that content. We will ask you to confirm this at checkout. If you have not started using the content, you can still cancel within 14 days for a refund.
- In-person training booked online: if you book a session or event more than 14 days ahead, you have 14 days to cancel for a refund, unless you asked us to start (or the session takes place) within that window, in which case the cancellation terms in section 10 apply.
To cancel within the 14 days, email us at vay@customcanine.co.uk. Nothing here affects your legal rights.
9. Refunds
- We refund using your original payment method.
- If digital content is faulty or not as described, you are entitled to a repair, replacement or refund under the Consumer Rights Act 2015. Contact us and we will put it right.
- Outside the cases above and your legal rights, one-off courses and membership fees are non-refundable once access has started, because the content is delivered immediately.
- In-person refunds follow section 10.
10. In-person training and events
- Booking: in-person sessions, classes and workshops are booked through our booking system (Bookwhen). The schedule, prices and any age or level requirements are shown there.
- Changing or cancelling your booking: if you need to cancel or move a booking, please give us at least [X days/hours] notice and we will refund or rearrange. For cancellations with less than [X days/hours] notice we [offer a transfer where possible, or cannot refund, to confirm]. [State any deposit or no-show policy.]
- If we cancel: if we have to cancel a session or event, we will offer you an alternative date or a full refund.
- Your dog: you confirm your dog is fit and healthy, vaccinated as appropriate, not unwell or (for group sessions) in season, and you will tell us in advance about any health, behaviour, reactivity or bite history so we can keep everyone safe. We may decline or stop working with a dog on welfare or safety grounds.
- Your responsibility: your dog remains your responsibility at all times during in-person sessions. You must keep your dog under control, follow our reasonable instructions, and you are responsible for any injury or damage your dog causes. We recommend you have suitable pet or third-party insurance.
- Our insurance and qualifications: we hold [public liability insurance, provider and details], and Vay is a qualified member of the Institute of Modern Dog Trainers (IMDT) and a certified scentwork instructor with Scentwork UK and the World Scent Dog Association (WSDA).
11. Acceptable use and intellectual property
You may use our site and content only for lawful, personal purposes. You must not misuse the site, try to break its security, or use it in any way that harms us or other users. All content on the site (videos, text, images, logos, course materials) is owned by us or our licensors and is protected by intellectual property law. The licence in section 6 is the only right you get; nothing else is transferred to you.
12. Training disclaimer
Dog training results depend on many things we do not control, including your dog, your consistency and your circumstances, so we cannot and do not guarantee any particular outcome. Our content and sessions are training guidance, not veterinary or medical advice. If your dog shows signs of pain, illness or a sudden behaviour change, please speak to your vet. You are responsible for deciding whether an exercise is suitable for your dog, and for your own and others’ safety when following it.
13. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not foreseeable, that you could have avoided, or that were not caused by our breach, and we are not liable for business losses (our services are provided to you as a consumer for personal use). Nothing in these terms affects your statutory rights as a consumer.
14. Availability and changes to the service
We try to keep the site and content available, but we do not promise it will always be uninterrupted, for example during maintenance, or because of our hosting or video provider. We may add, change or remove courses and features. If we make a significant change that affects content you have paid for, we will give you reasonable notice and, where appropriate, a refund.
15. Privacy
We handle your personal data in line with our Privacy Policy, which explains what we collect, why, and your rights.
16. Changes to these terms
We may update these terms. The version on the site at the time you buy is the one that applies to that purchase. For ongoing memberships, we will give you reasonable notice of any material change, and you can cancel if you do not accept it.
17. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you live elsewhere in the UK, you can bring proceedings in your own jurisdiction.
